Türkiye Modeli Başkanlık Hükûmeti Sistemi Ya Da "Cumhurbaşkanlığı Hükûmet Sistemi" Gerçek Bir Başkanlık Hükûmeti Sistemi Midir?

Abstract

21 Ocak 2017 tarih ve 6771 sayılı Türkiye Cumhuriyeti Anayasasında Değişiklik Yapılmasına Dair Kanun ile Türkiye'nin hükûmet sisteminde bir farklılaşma söz konusu olmuştur. Bu anayasa değişikliği ile Türkiye, yüz yıldan biraz fazla bir zamandır hükûmet sistemi olarak benimsediği ve uyguladığı parlamenter hükûmet sistemini terk etmiş; bunun yerine başkanlık hükûmeti sistemine benzer bir hükûmet sistemini kabul etmiştir. Bilindiği gibi başkanlık hükûmeti sisteminin en özgün biçiminin uygulandığı devlet, Amerika Birleşik Devletleri'dir. Anılan devlet uygulamasıyla Türkiye'de kabul edilen hükûmet sisteminin karşılaştırılması durumunda, iki sistem arasında önemli farklılıkların olduğu göze çarpmaktadır. Bu farklılıklar her iki sistemin, aynı hükûmet sistemi başlığı altında incelenmesini güçleştirecek boyuttadır. Esasında her iki sistem arasındaki farklılıklar derinlemesine incelendiğinde, Türkiye'de kabul edilen sistemin tamamen kendine özgü; diğer deyişle "Türkiye Modeli Hükûmet Sistemi" olduğu açıkça ortaya çıkmaktadır.

The Law on the Amendment of the Constitution of the Republic of Turkey dated 21 January 2017 numbered 6771 and there was a change in the government system of Turkey. With this amendment of the constitution, Turkey has abandoned the parliamentary government system which it has adopted and applied for a little more than a hundred years as the government system; adopted a government system similar to the presidential government system. As it is known, the most specific form of the presidential government system is the United States of America. If this government practice is compared with the accepted government system in Turkey, there is a big difference between the two systems. These differences will make it difficult for both systems to be examined under the same government system heading. In fact, when the differences between the two systems are examined in depth, it is clear that the accepted system in Turkey is completely unique; in other words, it is "Turkey Modeled Government System".
